General

These Terms & Conditions form part of the Customer Guide and are incorporated into the Business Customer Contract between each Customer and Plan Communications Limited (“plan.com”).

We reserve the right to amend these terms, or to withdraw or amend any tariff in this Tariff Guide at any time. If we do that, we will do so in accordance with the notice provisions set out in the General Terms and Conditions you have agreed to.

References to Plan in these terms and conditions are to Plan Communications Limited, registered under company number 010273V, with registered offices at No.5 Victoria Street, Douglas, Isle of Man, IM1 2LR.

Allowances, pricing and Charges quoted within this document are all on a per Connection/per SIM per month basis unless otherwise stated. All pricing stated in this document is exclusive of VAT.

Description

Our single tariffs offer a choice of network with a wide range of data allowances to choose from, including an Unlimited data option. Our single tariffs come with Unlimited minutes and texts that can be used anywhere in the UK and plan.com Europe Zone. Your data allowances can also be used in the plan.com Europe Zone without any additional roaming connectivity charges. Fair usage thresholds apply to unlimited usage, usage while roaming in Europe, and restrictions on gateway devices.

Our sharer tariffs are designed for businesses who typically want either shared data, or shared data with unlimited voice minutes and text messages across multiple devices. Optional additional data, text, and voice Bolt-Ons can be added on a ‘shared’ or ‘per device’ basis, with allowances that can be enjoyed in the UK and across the plan.com Europe Zone. Fair usage thresholds apply to unlimited, usage while roaming in Europe, and restrictions on gateway devices.

Single Tariff Limitations

Our single tariffs can only be used for single Connections. This means that the data, call, or text allowances cannot be shared across multiple Connections. Single tariffs may not be added to data-only equipment, such as routers, tablets or any machine-to-machine equipment. Our SIMs are prohibited from being used in SIM Gateway and SIM Box equipment. See “SIM GATEWAY/SIM BOXES” for more details.

Sharer Tariff Limitations

Sharer Tariffs require the nomination of a “lead” Connection. Additional Connections may then be added at any time during the Minimum Term of the Customer Agreement provided that the additional Connections must be within the data ranges specified for each Tariff in the sharer data table. Please be aware that the nominated lead connection can be changed and that disconnecting a lead connection may result in disruption of service to all services within the sharer.

Bolt-ons & Data Boosts

Customers who wish to purchase additional usage allowances (data, minutes, SMS or a combination thereof) may do so by purchasing a Bolt-On(s) or Data Boost(s) (as applicable).

Network Coverage

To make mobile voice calls you must be in an area with 2G or 3G coverage.

You can only make calls, send SMS, or use data on a 4G network if you are within a 4G enabled area and in range of a 4G base station. You will need a 4G compatible phone to make and receive calls, send SMS, or use data over a 4G network. 4G calling is not available when roaming.

You can only make calls on a 5G network if you are within a 5G enabled area and in a range of a 5G base station. You will need a 5G compatible phone to make and receive calls over a 5G network. 5G calling is not available when roaming.

Your 4G or 5G compatible phone will not necessarily be compatible with other 4G or 5G networks (as applicable) either inside or outside the UK.

Inclusive Allowances

Each Tariff includes a monthly allowance for data, minutes, SMS or a combination thereof (the “Inclusive Allowance”). Any data, minutes, or texts (as applicable) up to the amount of the Inclusive Allowance will be included within your agreed monthly Charges.

Inclusive Allowances apply for one calendar month only and cannot be rolled over to a subsequent calendar month.
The Inclusive Allowance of each Tariff only includes domestic usage, which is restricted to (1) data, calls, and SMS usage within the UK, (2) data, calls and SMS activity in and/or between our Europe Zone countries and (3) calls and texts from the Europe Zone back to the UK. The UK is defined as England, Scotland, Wales and Northern Ireland.

Data, Calls or SMS usage that exceeds any Inclusive Allowance will be charged at the appropriate rates as set out in our Pricing Guide – Additional Charges.

All Tariffs will be subject to the plan.com Fair Usage Policy. Certain Tariffs carry additional fair usage limits.

Fair Usage (unlimited allowances) 

All unlimited Data allowances are subject to a fair usage threshold of 650GB per service per month for domestic (UK) use and 25GB per month for Europe Zone (roaming) use.

Unlimited calls are subject to our fair usage threshold of 3,000 minutes per service per month.

Unlimited calls are subject to our fair usage threshold of 3,000 texts per service per month.

We reserve the right to disable access to this tariff if the policy is breached. Click here for more information on our Fair Usage Policy: www.plan.com/fairuse.

Charging: Additional Charges

Out of bundle charges (additional charges) will be incurred if you exceed an Inclusive Allowance or any call, SMS or data allowance included within that Inclusive Allowance, or access a service that is not included in your Inclusive Allowance e.g. premium rate calls or MMS. Additional Charges will be incurred at the rates set out in our Pricing guide. More information can be found in our Pricing Guide – Additional Charges.

Calling non-standard numbers

Call minutes only include UK to UK and Europe Zone to Europe Zone calls to standard numbers. Inclusive Allowances do not include calls or SMS to:

  • premium rate numbers
  • non-geographic numbers
  • non-mobile or call forwarding services
  • certain other numbers

Calls to these numbers will be charged in accordance with (a) the rates set by the operator of the number or the business providing the service; and (b) the rates (‘Access Charges’) that we charge to access these numbers from our network.

Call minutes exclude premium-rate numbers, which are often used by TV shows, quiz companies, chat providers and some websites. Prices are set by the premium operator. Call minutes exclude non-geographic numbers, which are often used by call centres and not associated with areas of the country e.g. 0161 for Manchester. They often start with 05, 07 or 08. Prices are set by the NGN operator. Some telephone numbers are operated by third parties, who connect or forward calls to another number. There are lots of third-party services and prices are charged by the third-party at a higher rate to connect calls. Calls to these non-mobile and call forwarding services are not included in your inclusive minutes.

Call duration

Charging for a call commences when a call is answered by a person or an answering device and ends when: (a) the call terminates on your Connection; (b) 16 seconds after your Connection loses signal for any reason (we continue to maintain the call in case your Connection re-establishes a signal with the network during this period); or (c ) you do not end the call up to 30 seconds after the last third party to you were connected to has ended their call.

Texting non-standard numbers

Text messages (SMS) only include UK to UK text messages. They exclude premium-rate numbers, which are often used by TV shows, quiz companies, chat providers and some websites. Customers may also be charged for receiving text messages from premium-rate numbers. Prices are set by the premium operator. More information can be found in our Pricing Guide – Additional Charges

Text Length

A single text/SMS message consists of 160 characters. If you send a longer message, you will be charged for two or more messages as appropriate. If you send an SMS longer than 160 characters, then it may be automatically converted into an MMS and could be charged an additional cost. More information can be found in our Pricing Guide – Additional Charges.

MMS

MMS are not included in our tariff packages. MMS stands for multimedia message service and a message is typically generated when you send a photo or picture. However, an MMS message may also be generated if you add an emoticon to an SMS, exceed a certain character limit for an SMS, or based on your device settings.

Mobile Data

Unless stated otherwise, Inclusive Allowances do not include use of a Connection outside of the Europe Zone. Therefore, using a Connection outside of the UK or Europe Zone means that you may incur Additional Charges.

Mobile data reception and speeds may not be as good indoors or in a car. Signal can also be affected by buildings, trees and even weather conditions.
If you exceed any mobile data allowance included within the Inclusive Allowance of a Tariff, you will be charged for any additional data use at the rates set out in our Price Guide – Additional Charges.

Tethering

We do not recommend using your Connection as a personal hotspot. Our Tariffs are designed for calls, texts, and general data use such as daily browsing. They are not designed for being used as (or in) a mobile broadband device, as this usually consumes a great deal of data.

All Tariffs are subject to our Fair Usage Policy www.plan.com/fairuse and this will apply even if you choose to tether. When you use your Connection as a hotspot, other, tethered devices will be using data from your Tariff. Depending on the number of devices connected and what they’re being used for, your data allowance could be used up (and exceeded) very quickly.

The reporting of the amount of mobile data used while tethering is subject to delays, sometimes of several days. This means that you may suffer delays in receiving usage notifications and the implementation of Spending controls, including Spend Caps and Spending Limits and bars.

The receipt of data usage from foreign network operators can also be subject to delay.

Tethering, where a Connection supplies mobile data to another device or devices, is monitored. Where we detect consistent tethering activity, occurring over different billing cycles, we reserve the right to:

  • Transfer you to a Tariff with a lower data allowance
  • At our absolute discretion, suspend, modify, or restrict the use of the Services
  • Withdraw access to the Service indefinitely
  • Terminate your contract, which may result in contractual termination fees

plan.com APN

To send and receive data, a Connection must access data through the plan.com APN. For information on data settings and APN, please visit www.plan.com/apn-settings or contact your plan.com partner.

Failure to configure to the plan.com APN may result in:

  • At our absolute discretion, suspending, modifying, or restricting the use of your Services
  • Withdrawing access to the Service indefinitely
  • Termination of contract which may also include contractual termination fees

What is roaming?

Roaming is when Equipment is used outside of the UK. For example, when you travel to a foreign country with your mobile phone. Your plan.com tariff does not include use of your service(s) outside of the plan.com Europe Zone (“EZ”). . Therefore, using Equipment outside of the UK or EZ means that you may incur additional charges, other than those described as part of your tariff, while using your service.

Equipment is ’being used’ while abroad when one or more of the following events take place:

  • Data is accessed by your device. This may happen as soon as a device (“Equipment”) connects with a foreign network provider. plan.com will charge you a fixed standard per MB rate for this data usage without an applicable roaming data Bolt-On. To prevent this, either mobile data must be turned off, roaming data must be turned off, the Equipment must be in Flight Mode and/or the Equipment must be turned off. PLEASE NOTE: Data can be accessed by your Equipment as soon as it is turned on, or Data access is enabled having been previously disabled. Data is not limited to specific apps being opened e.g., Facebook, an internet browser or Spotify. Background tasks often access data on your Equipment without your specific interaction. Therefore, your Equipment may be sending or receiving data simply by being turned on.
  • A call is made or received. In order to make or receive a call, your Equipment will automatically attempt to connect to a foreign network provider. The third-party will fulfil this call request. You can prevent calls from being received while abroad by keeping your Equipment in Flight Mode, or asking for an incoming call bar to be applied. plan.com will charge you a fixed standard per minute rate for this usage (see pricing) unless the usage is bundled with a roaming voice Bolt-On.
  • A text message is sent. As above, this Service will be fulfilled by a foreign network provider and plan.com will charge you a fixed rate per text (see our pricing guide) unless the usage is bundled with a roaming SMS Bolt-On. Multimedia Messages (MMS) are not covered by roaming Bolt-Ons or Add-Ons and are prices accordingly.

Our Daily and Monthly Roaming Bolt-Ons and Add-Ons are a range of products designed to support those Customers who want to use their services while roaming while staying in control of their costs.

Additional charges while roaming

Customers who use their service(s) while roaming to access data, make or receive calls, or send texts and do not have an applicable roaming Bolt-on or add-on in place will incur additional charges.

Customer will also incur additional if their usage exceeds both (i) the relevant allowance included within the Inclusive Allowance of the Customer’s Tariff and (ii) the additional daily or monthly allowance provided by any Bolt-On, Add-On or Data Boost that has been applied.

International usage

The Inclusive Allowance of each Tariff only includes domestic usage, which is restricted to:

  • Data, calls, and SMS usage within the UK,
  • Data, calls, and texts activity in and/or between our Euro Zone countries
  • Calls and texts from the Europe Zone back to the UK. The UK is defined as England, Scotland, Wales and Northern Ireland.

International usage relates to calls and texts that originate in the UK and are received by services outside of the UK. plan.com tariff allowances do not include International calls and SMS as standard.

Unless stated otherwise, International usage is not part of an Inclusive Allowance.

International usage does not include making calls or sending SMS while abroad (this usage is classed as roaming usage, no matter where the call or SMS is received). Accordingly, International usage does not include calls back to the UK unless that call is made from a plan.com Europe Zone destination.

Our International Bolt-Ons are a range of products designed to support those Customers who make a lot of International calls or send a lot of International Text messages.

If you have an International Bolt-On or Add-on and subsequently exceed any allowance provided for International calls or SMS, Additional Charges will apply.

Additional charges: international usage

Customers who use their service(s) while in the UK to call or text services outside of the UK will incur additional charges unless they have an International Bolt-on relevant to the countries in which the calls or texts are received.

Customer will also incur additional if their usage exceeds both (i) the relevant allowance included within the Inclusive Allowance of the Customer’s Tariff and (ii) the additional daily or monthly allowance provided by any Bolt-On that has been applied.

Roaming in Europe

Customers with tariffs and Bolt-ons that include UK allowances may use their UK allowances when roaming in the plan.com Europe Zone (EZ).

For a list of destinations included in our Europe Zone, click here.

Usage in these destinations will be deducted from your domestic tariff allowances. For example, our pro.plan 6GB tariff customers will enjoy 6GB of data to use in the UK and EZ. If you use 500MB in France, 500MB will be deducted from your pro.plan 6GB data allowance.

If you exceed your tariff data allowance and/or Bolt-On or Add-On allowance while roaming in the EZ you will be charged at the same out of bundle rates that apply to the UK.

The following usage is included with the UK tariff allowance:

  • All data usage in the EZ1
  • Calls and texts back to the UK from an EZ destination (including voicemail retrieval)
  • Calls and texts within an EZ destination, e.g. Spain to Spain
  • Calls and texts from one destination to another where both are in the EZ, e.g. Spain to Germany (except where calls or texts originate in the UK – these are still regarded as international calls/SMS)

The following usage is excluded from the UK tariff allowance:

  • Calls and texts from the UK to destinations in the EZ will not be included in UK Tariffs – these are international calls/texts
  • Calls and texts from in the EZ to a non-EZ destination, e.g. Spain to the USA are classified as Out of Zone Calls/Texts and subject to fixed per minute/SMS charges (see pricing guide for more information)
  • Calls and texts to Premium/Non-Geographic numbers are not included, neither are texts received from premium rate numbers

Calls & Texts to  Europe Zone (international)

Calls and texts to Europe Zone means calls and texts that originate in the UK and are received by services in the plan.com Europe Zone. These are classed as International Calls and Texts.

Calls and texts to Europe do not include calls and texts made while a service is roaming in the Europe Zone. These are classed as Roaming Calls and Texts. 

International calls are charged by the minute, with a one-minute minimum call charge.

Unless a relevant Bolt-on or Add-On is applied, international calls and texts are charged at the standard out of bundle international call and text charge rates. More information can be found in our Pricing Guide – Additional Charges.

Calls & Texts to countries outside of the Europe Zone (international)

Calls and texts to countries outside of the plan.com Europe Zone means calls and texts that originate in the UK and are received by services outside of the UK and plan.com Europe Zone. These are classed as International Calls and Texts.

Calls and texts to international destinations do not include calls and texts made while the service making the call or sending a text is roaming. These are classed as Roaming Calls and Texts. 

International calls are charged by the minute, with a one-minute minimum call charge.

Unless a relevant Bolt-on or Add-on is applied, international calls and texts are charged at the standard out of bundle international call and text charge rates. More information can be found in our Pricing Guide – Additional Charges.

Roaming calls and texts within Europe Zone

Roaming calls and texts within Europe Zone include: Calls and texts from the Europe Zone back to the UK, In Country (e.g. France to France), and In Zone (e.g. France to Germany).

Roaming calls and texts within Europe Zone do not include Out of Zone (e.g. France to America).

Roaming calls and texts within Europe Zone do not include calls that originate in the UK and are received by services in the plan.com Europe Zone. These are classed as International Calls and Texts.

Unless a relevant Bolt-on or Add-On is applied, roaming calls and texts are charged at the standard out of bundle roaming charge rates. More information can be found in our Pricing Guide – Additional Charges.

Fair Usage while roaming

The Fair Use Threshold for all mobile or MBB data usage while roaming outside of the UK (including roaming in the Europe Zone) is 25GB per service per month.

The Fair Use Threshold for all mobile call usage while roaming outside of the UK (including roaming in the Europe Zone) is 3,000 minutes per service per month.

The Fair Use Threshold for all mobile text usage while roaming outside of the UK (including roaming in the Europe Zone) is 3,000 texts per service per month.

If, at the absolute discretion of plan.com, your data, call and/or text usage exceeds the Fair Usage Threshold as described above, we may contact you by email, text, or telephone to advise you accordingly, but we reserve the right to bar your service.

When we contact you, we will provide you with the opportunity to rectify the situation by ceasing, or substantially reducing, your call and/or text usage. If excessive usage continues, or if for any reason we reasonably suspect that you are not acting in accordance with this policy, we reserve the right to take further action.

  • Such action may include, but is not limited to:
    Removing the roaming Bolt-On or Add-On
  • Transferring you to a tariff that does not include unlimited calls, texts and/or data
  • At our absolute discretion, suspending, modifying or restricting the use of your services
  • Withdrawing access to the service indefinitely
  • Termination of contract, which may also include contractual termination fees

Fair Usage while roaming: permanent or semi permanent residency

plan.com tariffs, Bolt-Ons and Add-Ons are intended for customers and users with a stable link to the UK who travel abroad periodically. They are not intended for users roaming on a permanent or semi-permanent basis.

We reserve the right to monitor usage patterns of plan.com customers to reasonably determine whether a Customer may be abusing the regulatory right that permits Customers to use an Inclusive Allowance whilst roaming.

If a customer spends more than two months abroad out of four months or if the customer has consumed more data abroad than at home over this time, we may send an alert to that customer.

Once the alert is received, the customer will have two weeks to clarify the situation. If the user continues to remain abroad, we reserve the right to apply surcharges (equivalent to wholesale roaming caps, agreed on 31 January 2017).

Roaming near borders

While roaming in countries that border with other destinations that fall outside the region or zone (e.g. The Republic of Cyprus, which borders with the Turkish Republic of Northern Cyprus), it is possible for a roaming mobile phone to connect with a mobile mast in the neighbouring country. In the example of Cyprus and Turkey, voice, text and data charges are set at the higher, non-Euro Zone rates.

When it comes to data usage, this can be up to £6 per MB. This is also true of maritime, satellite and airborne networks. plan.com is not able to control which network your Equipment connects to. For this reason, we are not liable for any additional charges that are incurred.

Maritime, Satellite and Airborne networks

Maritime, satellite and airborne networks are not included in any plan.com tariff or Bolt-on allowances, even though they may be based in one of our roaming zones.

plan.com cannot be held responsible for Equipment accessing these networks and is not liable for any additional charges that are incurred from Equipment using these networks, even if accidental.

Please take extra care when travelling off-land or within areas not covered by mobile operators. We suggest putting your device into flight-safe mode in these situations or turning off roaming data on your device.

Using your phone as a personal hotspot while roaming 

We do not recommend using your phone or connected device as a personal hotspot. Services on standard mobile tariffs are designed for calls, texts and general use such as daily browsing. They’re not designed for being used as (or in) a mobile broadband device, as this usually consumes a great deal of data.

When you use your phone as a hotspot, all devices will be using data from your phone. Depending on the number of devices connected and what they’re being used for, your data allowance could be used up (and exceeded) very quickly.

In addition to this, the reporting of the amount of data used while tethering is subject to increased delays, sometimes of several days. This means that we may not be able to react as quickly to tethered data use as standard data use. Therefore, any data alerts and/or bars set up on your account will also be delayed. This could lead to additional charges on your account.

The reporting of data while roaming outside the UK can further increase the delay in data reporting. Due to the increased cost of using data outside the UK/EU, we highly recommend that you avoid using your phone or connected device as a personal hotspot while roaming.

SIM Gateway/SIM boxes

A SIM gateway refers to the use of a mobile or MBB SIM card in mobile equipment beyond the scope of the traditional mobile handset, tablet, or similar device. For example, gates, lights, routers, etc.

It is a solution that might be used by a business that requires a data-only tariff, where they do not require any minutes or texts but still require connectivity to a data network.

A Gateway Device/SIM Box may also mean a device(s) containing one or more SIMs for one or more mobile networks and which enables the automatic routing of calls to mobile networks, landlines or to generate SMS Text(s).

The Gateway/SIMBox also results in mobile consumers being unable to use services that they would expect to be able to use, including: returning a missed call; sending an SMS; screening unwanted or malicious calls (call rejection); and using Calling Line identity (CLI) to manage costs when roaming / receiving calls from overseas (deciding whether to accept the call).

Plan does not agree to provide service to operators of any Gateway Devices/SIM Boxes. Where they are found to operate, Plan is entitled to and will take immediate steps to withdraw service, on the basis that their continued operation effectively puts Plan and The Network in breach of its Conditions of Entitlement.
